Insulet Corp. was sued for securities fraud over Omnipod defects that triggered two recalls and a 12% stock decline.
"The company's manufacturing controls and procedures were defective, creating a foreseeable risk that its products would be found in violation of safety regulations," the complaint alleges. The lawsuit was filed by Bleichmar Fonti & Auld LLP in the U.S. District Court for the District of Massachusetts on behalf of investors who purchased Insulet securities between Feb. 21, 2025 and May 26, 2026.
Insulet disclosed the first voluntary Medical Device Correction on March 12, 2026, for specific lots of Omnipod 5 Pods after identifying a manufacturing issue that caused a tear in the internal tubing delivering insulin. The stock fell $16.23, or 6.88%, to close at $219.84 on March 13. On May 26, the company announced a second correction covering Omnipod 5, Omnipod DASH and Omnipod Eros systems due to a similar tubing defect that could result in insulin under-delivery. Shares dropped another $7.79, or 5.07%, to $146.01 on May 27.
The recalls have wiped 38% from Insulet's stock since early March, with shares falling from $236.07 before the first disclosure to $146.01 after the second. The lead plaintiff deadline is Aug. 31, and investors with the largest financial interest in the relief sought may move to direct the litigation.
The complaint asserts claims under Sections 10(b) and 20(a) of the Securities Exchange Act of 1934. It alleges that Insulet's public statements during the class period were materially false because the company failed to disclose that its manufacturing controls were defective and that its products posed a risk of injury to patients. Insulet develops and sells insulin delivery systems through its Omnipod platform, competing with Medtronic Plc and Tandem Diabetes Care Inc. in the insulin pump market. The company has not yet responded to the allegations.
At least two other law firms — Faruqi & Faruqi LLP and Rosen Law Firm — have also announced investigations or reminded investors of the Aug. 31 lead plaintiff deadline, indicating broad legal interest in the case.
The lawsuit adds legal risk to Insulet's operational challenges as the company works to resolve the manufacturing issues behind the recalls. Investors will watch for any further product corrections and the company's next quarterly filing for updates on remediation costs.
